The Sharks who lost 25-21 to the Waratahs in Sydney in round four of the Super 14 will ask SANZAR to review the performance of referee Paul Marks after claiming Phil Waugh "got away with murder" at the breakdown.

The South Africans were fuming over a controversial finish to the game and they claim that they should have been awarded a match-winning penalty try.

Sharks fullback Stefan Terblanche created an overlap with three minutes remaining on the clock and sent a pass out to Ryan Kankowski but Kurtley Beale knocked down the ball to the ground ending the movement.

Beale was sin-binned and the Sharks pleas for a penalty try were ignored by referee Paul Marks.

"That was a cynical decision right at the end there (by Beale). That should have been a penalty try, "Sharks coach John Plumtree told the Daily Telegraph.

"Ryan Kankowski runs quicker than a winger: he would have skated in there and that was the game,"

"He obviously thought there was cynical intent," Smit said.

"We can cry about spilt milk all day, but that's what happens when you play away from home."

"When you lose three in a row, referees don't go with the team who have lost three in a row."

Waratahs coach Chris Hickey however said that Beale "had gone for the intercept, rather than knocking the ball down".
